Depositions India Checklist

The requirements for taking U.S. depositions in India are straightforward and easy to follow using the Planet Depos checklist specific to India.

India is party to the Hague Convention, which means that taking a U.S. deposition of voluntary witnesses can occur without prior approval from the Indian Central Authority. Allowing enough time (roughly between 4-6 weeks is ideal) for scheduling depositions in India is extremely important because of the logistics associated with the scheduling and planning processes. However, as the only firm with teams living on-the-ground throughout Europe and Asia, we are often able to cover last-minute requests.

Counsel will determine whether their witness is willing to be deposed. If so, both parties can stipulate and begin the process of setting up the deposition. For specific information pertaining to taking depositions in India, please consult the U.S. Embassy’s website for Judicial Assistance.

Taking a deposition in India can be easily done by taking the necessary steps as outlined in the checklist for U.S. depositions in India. India is a country that is very English-friendly and therefore is easy to travel around. With many excellent business hotels, there is no shortage of excellent accommodations for a conference room and for comfortable lodging. Entry Requirements for India

To enter India from the United States, you must apply for a business visa. Below are the items you’ll need:

  1. An original and signed U.S. Passport with a minimum of six (6) months’ remaining validity and at least two (2) blank visa pages.
  2. One (1) additional passport photograph
    • Do not wear glasses in your photograph
  3. Driver’s License copy
    • Address must match address on your application
    • If your name has changed, a marriage certificate is required for proof
  4. An original business letter from the sending company in the U.S.
  5. An original business invitation from the inviting company in India

Money Matters

The official currency of India is the Indian Rupee. Unfortunately, you cannot obtain the Rupee outside of India and it is not accepted anywhere outside of the country. An exchange portal will be available at the airport upon your arrival in India and it is advised you exchange money there if only for your trip to your hotel. India is one country where bartering prices is necessary as things even such as cab rides can be haggled. ATMs are located in most major cities in India and often prove to be a traveler’s best resource for money exchanging and withdrawal.

Weather

The four seasons in India are different from what many think of as “normal” seasons. Winter, summer, Monsoon, and Post-monsoon (Autumn) are the titles given to the different stages of weather in India. However, because India is such a big country, the different weather types can differ between the North and the South. It is best to know the exact city in India your deposition will be in and then plan accordingly.
