In this article we’ll discuss our tips on how to take a deposition in Slovakia.
Slovakia is best known as one half of the bygone Czechoslovakia: a country with a relatively peaceful split in 1993. Today, Slovakia is known for its beautiful mountains and charming central European towns. The country is particularly easy to enjoy, as depositions in Slovakia are straightforward to schedule compared to its surrounding neighbors.
Voluntary depositions may be conducted in Slovakia regardless of the deponent’s nationality as long as no compulsion is used. Prior permission from the Slovakian Competent Authority, however, is required for depositions taken pursuant to a commission. Information on the Authority can be found on The Hague Convention’s website. The deposition itself can be taken at a wide variety of venues – including hotels, offices, law firms, or at the U.S. Embassy in Bratislava.
There are two options regarding the administration of the oath at the start of a deposition in Slovakia. First, all counsel may stipulate on the record that they understand the reporter is not a Notary Public in this venue but would like him/her to administer the oaths. If this option is chosen, the court reporter will request that this stipulation be placed on the record each day. Alternatively, counsel can reach out to the U.S. embassy in Bratislava directly for a U.S. consular officer to administer the oath. This option is dependent on consular officer availability and should be done several weeks in advance of the deposition. It is also wise to ensure that all technical equipment is compatible to electrical equipment in Slovakia – electricity adapters are key!
Finally, if you have a day or two to spare, Slovakia has a rich history of performing arts. From local folk performances commemorating local holidays to formal orchestras and chamber groups, there are plenty of opportunities to soak up Slovakian culture!
